Bluebonnet Internet Policies

Purpose: To determine and implement policies regulating and
administrating customer services as provided by Bluebonnet
Internet.
This document and related policies may change without notice
and will be updated on a regular basis.
Acceptable Usage Of PPP Accounts:

Appropriate Usage Policy (AUP)
Bluebonnet Internet maintains an appropriate usage policy
to ensure the safety and satisfaction of our customers. In
addition to your affirmation that you will not use Bluebonnet
service for any purpose constituting abuse of service, you
agree to comply with all applicable local, state, federal,
and international laws and guidelines. Violations and abuse
of service include, but are not limited to, the following:
· Engaging in any activity that is prohibited by any
applicable local, state, federal, or international law or
regulation.
· Gathering information about other users, including
e-mail addresses,without their consent.
· Creating a false identity for the purpose of misleading
others, especially when sending e-mail messages or posting
to a newsgroup.
· Connecting to Bluebonnet Internet multiple times
simultaneously with the same account without paying for concurrent
service.
· Maintaining a dialup connection by artificial means
for the purpose of keeping the connection open while unattended.
Bluebonnet Internet dialup connections are intended to be
open for active use only. Bluebonnet Internet reserves the
right to terminate a connection following an extended period
of inactivity.
· Running any type of server (web, mail, ftp, gaming,
etc.) that requires extended connections.
· Sending large amounts of unsolicited e-mail (see
Spamming Policy below).
Bluebonnet Internet reserves the right to terminate an account
for violations of its terms of use. Bluebonnet Internet, at
its sole discretion, will determine whether customer actions
are considered abuse of service. If you are unsure whether
a particular action is considered abuse, please contact a
Bluebonnet Internet representative.
Notice of Liability for Long-Distance Charges
While Bluebonnet's support representatives will make every
effort to assist you in selecting an access number that is
a local phone call from your exchange, it is your responsibility
to ensure that the selected access number is a local call.
We recommend that you contact your phone company and ask them
if the dial-up number, given to you by any Bluebonnet Internet
support representative or reselling agent, will result in
a long-distance charge if used. If, after signing up with
Bluebonnet Internet, you determine that the access number
initially given to you is not a local call, we will assist
you by suggesting an alternate number or disconnecting your
service at no penalty to you. All telecommunications charges
are the sole responsibility of the telecommunications customer.
Please also be aware that accessing our Toll Free Travelers
Package number will result in additional charges, billed to
your account at 11 cents per minute.
Inactivity And Disconnect Policy:
The account may be disconnected automatically within 20 minutes
of inactivity. This time is general and subject to change
as mandated by the System Administrator of Bluebonnet Internet.
Inactivity is defined as periods when no activity is detected
by Bluebonnet Internet through electronic means and the account
is not being actively used by a dialup user. Electronic or
mechanical means to avoid an inactivity disconnect are strictly
prohibited. Electronic or mechanical means include: pinging
the mail server; electronic or software autodialer features
to maintain an active connection; repetitive checks for e-mail
by autologin to the mail server. Abuse of these conditions
and others not identified can result in a customer having
their account disabled until these processes are halted in
agreement with Bluebonnet Internet Appropriate Use Policy.
Electronic means of auditing a suspected abused connection
will be done by Bluebonnet Internet with the above guidelines
in mind and with respect for the customer's privacy. Continued
abuse or violations of the above conditions my result in a
customers account being permanently disabled and all previous
agreements rendered null and void.
Customer Responsibility and Cooperation:
All customers and subscribers of Bluebonnet Internet agree
unconditionally to not in any way intentionally or maliciously
cause harm to the equipment, software, or processes operating
Bluebonnet Internet. Any violations of this agreement will
result in civil and/or criminal penalties as prescribed by
local, state and federal laws applicable in this area.
The Internet hosts some material deemed unfit for viewing
and reading by minors under the age of 18. Some sites contain
information both in text and graphical formats that may be
considered obscene or harmful. Customers and subscribers of
Bluebonnet's services will not hold Bluebonnet Internet responsible
for sites and postings which could be considered obscene,
lewd, offensive and/or harmful. It is Bluebonnet Internet
policy that individuals are responsible for their own monitoring
and viewing habits and those minors in their care. We currently
do not filter or screen postings or sites on the Internet
on a regular account, however we offer an excellent filtering
software (Bess Filter) that can be added on your regular account.
In addition to this, customers and subscribers are encouraged
to use common sense and courtesy when creating postings and
or sites on personal or our WWW commercial server that may
be considered offensive to others.
Acceptable Use Of Bluebonnet Internet Web Servers And Restrictions:
Users of Bluebonnet Internet Web Services, will be subject
to additional charges if their site is receiving excessive
use.
We expressly reserve the right to disable web sites generating
excessively significant traffic (significantly excessive traffic
is defined as any amount of activity that noticeably detriments
performance on the server in question) We also expressly reserve
the right to disable logging on sites generating significant
excessively traffic
Customers Shall Be Precluded From Doing Any Of The Following:
Posting or transmitting any transmissions constituting or
encouraging conduct that would constitute a criminal offense,
giving rise to civil liability, or otherwise violating any
local, state, national or international law, including without
limitation the U.S. export control laws and regulations.
Posting or transmitting any information or software which
contains a virus, worm, cancelbot or other harmful component.
Uploading, posting, publishing, transmitting, reproducing,
distributing or participating in the transfer or sale, or
in any exploiting any information, software or other material
obtained through the Internet which is protected by copyright
or other proprietary right or derivative which is protected
by copyright or other proprietary right or derivative works
with respect thereto, without obtaining permission of the
copyright owner or right holder. Activities that disrupt the
use of or interfere with the ability of others to effectively
use the network or any connected network, system, service,
or equipment is prohibited.
Abusing or fraudulently using the Service in any way not specifically
set forth above.
Customer understands further that the Internet contains unedited
materials, some of which are sexually explicit or may be offensive
to some people. Customer and Customer's authorized users access
such materials at Customer's own risk. Moreover, Customer
acknowledges that they will comply with all legislation, regulations,
case law, and ordinances that regulate the transmission of
information content over the Internet.
Using any Bluebonnet Internet account or server to send duplicative,
unsolicited e-mail messages (commercial or otherwise), or
to collect the responses from unsolicited e-mail (for example,
by maintaining a SPAM-advertised web site) is prohibited.
Bluebonnet reserves the right in its sole discretion to determine
whether duplicative or mass e-mail messages are "unsolicited."
A complaint from the recipient is presumptive evidence that
the message was unsolicited.
Bluebonnet has no obligation to refer complaints to the sender
or to identify complaining parties. Conduct that directly
or indirectly encourages, permits, or relies on spamming is
included in this prohibition. Examples include failure to
implement technical or administrative measures to prevent
mass unsolicited e-mail, or providing SPAM "support services"
such as e-mail dropboxes or sales of spamware. Similarly,
using any Bluebonnet account or server to post advertisements
or messages that violate the charter of any newsgroup or mailing
list is prohibited. Bluebonnet Internet reserves the right
to make the determination whether a given message violates
the newsgroup or mailing list charter. In most cases Bluebonnet
will defer to the judgment of the newsgroup or mailing list
moderator or administrator.
Spamming is defined by Bluebonnet Internet as -- Sending unsolicited
bulk and/or commercial messages over the Internet. Also, maintaining
an open SMTP relay is prohibited (web server, mail server,
etc.) When a complaint is received, Bluebonnet Internet has
the discretion to determine from all of the evidence whether
the email is considered SPAM.
Commercial messages that are appropriate under the charter
of a newsgroup or
mailing list, or that are expressly solicited by the recipients,
are permitted.
Billing / How Your Account Is Charged / Additional Fees:
I. Payments on the accounts are always charged one month
in advance. Our billing cycle extends from the first of the
month to the last of the month. Current monthly charges will
be due on the 25th of each month. An additional grace period
will be given up to the 5th of the following month. A "friendly
reminder" will be sent to your Bluebonnet e-mail address.
Accounts not paid by the given date will be suspended for
nonpayment. If an account is suspended for nonpayment, a $10.00
reconnection fee will be charged in addition to the balance
owed to restore the account. Accounts will be restored within
24 hours of payment. Any checks returned to Bluebonnet unpaid
will have a service charge of $25.00. Cancellation Policy--
It is required that request to cancel service is received
in writing by postal mail or email to billing@bluebonnet.net
30 days in advance. If a 30-day notice is not given, any prepaid
services will not be refunded.
II. Automatic Payment Recurrence
If you elect to pay with a credit card on a continual basis,
Bluebonnet Internet will automatically bill your credit card
when the next payment is due. If you pay annually, an annual
payment will automatically be charged to your credit card
the following year. If you pay monthly, the monthly fee will
automatically be charged each month.
If you elect to pay using an electronic check on a continual
basis, Bluebonnet Internet will automatically debit your checking/savings
account when the next payment is due. If you pay annually,
an annual payment will automatically be deducted from your
account the following year. If you pay monthly, the monthly
fee will automatically be deducted from your account. To prevent
an automatic debit, you must either cancel your Bluebonnet
service, or change the account you wish to have billed before
your next billing cycle.
You may elect to change billing methods, credit accounts or
checking accounts at any time. To do so, please call Bluebonnet
Internet before your next payment is due and provide us with
the information for the account you would like to have charged.
To avoid late fees, overdraft fees or other inconveniences,
please ask the Bluebonnet Billing Department when you can
expect each payment to be charged or deducted, so that you
can plan for the transaction in advance. Charges for monthly
dialup accounts are not prorated in the event of cancellation.
When you call Bluebonnet Internet to cancel a monthly dialup
account, the account will become inactive as of the last day
of the current charge period, and you are responsible for
all charges up to the end of the
current period. If you wish to dispute any charges, you must
contact Bluebonnet Internet within 90 days of the disputed
charge. Any disputed charges more than 90
days old will not be refunded. Bluebonnet Internet takes the
security of its customer's billing information very seriously.
Impersonating the identity of another individual or
willfully submitting inaccurate billing information, including
credit card numbers, bank routing numbers, or bank account
numbers, will be considered fraudulent activity, and perpetrators
will be prosecuted to the fullest extent of the law.
Bluebonnet Internet reserves the right to alter, limit or
refuse service to any customer that we believe to be abusing
the use allowed them without notice. Bluebonnet Internet reserves
the right to change the terms, conditions and rates without
